These Terms of Service ("Terms") govern your access to and use of Atmosphere ("Atmosphere," "we," "us," or "our"), including our websites, mobile applications, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Acceptance
By creating an account, booking or listing an event, or otherwise using the Services, you represent that you are at least the age of majority in your jurisdiction and that you have the legal capacity to enter into a binding agreement. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to update it as needed. We may suspend or terminate accounts that violate these Terms or that present security or legal risk.
3. Event Bookings
Atmosphere facilitates discovery and booking of events. Specific ticket terms, refund policies, and event rules are set by hosts or organizers and may be presented at checkout or on the event page. You are responsible for reviewing those terms before completing a purchase. Disputes regarding admission, cancellations, or refunds are primarily between you and the host, though we may offer reasonable support or dispute tools where available.
4. Host Responsibilities
If you list or manage events as a host, you agree to: (a) provide accurate descriptions, pricing, capacity, and scheduling information; (b) comply with applicable laws, including permits, safety, accessibility, and tax obligations; (c) honor valid bookings and communicate material changes promptly; and (d) not use the Services to facilitate illegal or harmful activities. You grant Atmosphere a license to display and promote your event content as needed to operate the Services.
5. Prohibited Conduct
You agree not to:
- Violate any law or third-party rights
- Harass, abuse, defraud, or impersonate others
- Upload malware, scrape the Services in violation of our policies, or attempt unauthorized access
- Circumvent fees, verification, or security measures
- Use the Services to distribute spam, hate speech, or illegal content
- Resell or misuse tickets in violation of host rules or applicable law
6. Intellectual Property
The Services, including branding, software, and design, are owned by Atmosphere or its licensors and are protected by intellectual property laws. You retain rights to content you submit; you grant us a worldwide, non-exclusive license to host, display, and distribute that content in connection with the Services. Feedback you provide may be used without obligation to you.
7. Limitation of Liability
To the fullest extent permitted by law, the Services are provided "as is" without warranties of any kind. Atmosphere is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Services will not exceed the greater of (a) the amounts you paid to Atmosphere for the Services in the twelve months before the claim or (b) one hundred U.S. dollars ($100), except where liability cannot be limited by law.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under applicable law.
8. Dispute Resolution
You agree to first contact us to resolve disputes informally. If a dispute cannot be resolved, you and Atmosphere agree that disputes will be resolved in the courts or arbitration forum specified in our supplemental terms for your region, or otherwise in accordance with applicable law. You waive any right to participate in a class action to the extent permitted by law.
9. Changes to Terms
We may modify these Terms from time to time. We will post the updated Terms and update the "Last updated" date. Material changes may be communicated through the Services or by email. Continued use after changes become effective constitutes acceptance of the revised Terms.
10. Data Collection & Processing
To ensure platform safety, prevent fraud, improve the Services, and comply with legal obligations, Atmosphere collects and processes data related to your use of the Services. This includes, but is not limited to:
- Account information (email address, display name, profile data)
- Device information (device type, operating system, browser type and version)
- Network information (IP addresses, approximate geolocation derived from IP)
- Usage data (pages viewed, features used, search queries, browsing behavior)
- Communication data (messages sent through the platform, including content analysis for safety moderation)
- Transaction data (bookings, payments, ticket activity)
- Login and session history (timestamps, devices, locations)
We may enrich the data we hold with publicly available information from external sources for the purposes of fraud prevention, identity verification, and platform integrity. This data processing is carried out under our legitimate interest in maintaining a safe and trustworthy platform (GDPR Article 6(1)(f) for users in the European Economic Area).
Data is retained for as long as your account is active or as needed to fulfill the purposes described above, and thereafter as required by applicable law. You may request access to, correction of, or deletion of your personal data by contacting us at the address below, subject to legal retention requirements.
